Lei n.º 93/2021 de 20 de dezembro – Estabelece o regime geral de proteção de denunciantes de infrações, transpondo a Diretiva (UE) 2019/1937 do Parlamento Europeu e do Conselho, de 23 de outubro de 2019, relativa à proteção das pessoas que denunciam violações do direito da União

Esta política rege as atividades da ADA Fios, S.A., no âmbito do regime geral de proteção de denunciantes de infrações. Esta política de denúncias foi estabelecida para facilitar a denúncia adequada de qualquer infração, sem que o denunciante tenha de temer um impacto negativo da mesma.

A conduta da empresa rege-se pela transparência das suas ações nas várias áreas de negócio, de forma a manter padrões elevados de integridade.

No entanto, isso não altera o facto de poderem ocorrer irregularidades.

Acreditamos que os funcionários e/ou pessoas externas à empresa, que suspeitam de irregularidades devem ser capazes de reportar isso de forma simples e segura. Assim sendo, a ADA Fios, S.A. promove esta política de denúncias para permitir uma investigação imediata e completa das suspeitas. Além disso, deve ser garantida a proteção necessária para que continuem a sentir-se seguros.

Esta política de denúncias permite que uma (suposta) irregularidade seja denunciada o mais cedo possível, não esperando, contudo, que quem o faça provem que o que afirma é verdade. No entanto, eles devem ser capazes de demonstrar que existem factos e/ou circunstâncias que justificam a suspeita razoável de irregularidades.

Abrangência

Todas as pessoas internas e/ou externas à ADA Fios, S.A. podem fazer uso da política de denúncias, incluindo funcionários, fornecedores, prestadores de serviços.

Procedimento

O canal preferencial para a apresentação de denúncias é o formulário eletrónico disponibilizado no site da ADA Fios, S.A., criado especificamente para o efeito. O formulário permite que a denúncia seja apresentada de forma anónima ou mediante a identificação do denunciante.

Em alternativa, a denúncia pode ser apresentada verbalmente através da linha de apoio dedicada, indicada no site, ou, mediante solicitação do denunciante, em reunião presencial. Todos os meios disponibilizados asseguram a confidencialidade, a integridade e a conservação da denúncia, impedindo o acesso de pessoas não autorizadas.

Alternativamente, as denúncias poderão ser submetidas via e-mail (denuncias@ada.pt), por correio postal (morada: Rotunda do Complexo Desportivo, n.º 15, 4595-069 Seroa, Paços de Ferreira) ou presencialmente junto do Departamento de RH, na sede da empresa.

Em qualquer situação está sempre garantida a independência, a imparcialidade, a confidencialidade, a proteção dos dados, o sigilo e a ausência de conflitos de interesse.

Após a receção da denúncia, no prazo de sete dias, o denunciante é notificado da sua receção e é informado dos requisitos, autoridades competentes e forma e admissibilidade da denúncia.

No seguimento de qualquer denúncia recebida, esta é analisada e dá-se início à abertura de um inquérito interno de forma a analisar as alegações contidas na denúncia. Sempre que se justifique procede-se também à comunicação às autoridades competentes.

No prazo máximo de 3 meses, a contar da data de receção da denuncia, procede-se à comunicação ao denunciante as medidas adotadas e a respetiva fundamentação.

Será mantido um registo das denuncias recebidas e tratadas durante 5 anos, ou independentemente desse prazo durante a pendência de processos judiciais ou administrativos referentes à denúncia.

Confidencialidade

Será sempre salvaguardada a confidencialidade da identidade do denunciante.

A identidade do denunciante só poderá ser divulgada em decorrência de obrigação legal ou de decisão judicial.

O tratamento de dados pessoais observa o disposto no RGPD.

Sem retaliação contra o denunciante

É proibida a prática de qualquer ato de retaliação contra o denunciante.
